1.General These Terms of Use (“Terms of Use”) belong to Gross, Colen, Brenner & Co. Law Offices (“GCB” or the “Site Operator”) and apply to any use made of the website located at gcblaws.com as well as all digital platforms, including social networks and/or landing pages owned by the Site Operator and/or the services provided on the Website (collectively hereinafter – the “Website”). Browsing the Website and access to services on the Website is subject to the conditions detailed in these Terms of Use.

The Website does not provide and/or intend to provide any legal or professional advice whatsoever, and the Content included therein does not constitute legal advice and/or professional advice and/or a legal opinion and/or a recommendation, and should not be relied upon or used as a source for legal advice. The provisions of the Terms of Use shall apply to any use made by you on the Website as defined below and to any engagement performed by you via the Website, and shall constitute the legal basis for any discussion between you and the Site Operator as defined above. The Site Operator reserves the right to amend and/or cancel and/or change the provisions and conditions stated in the Terms of Use, from time to time, at its sole discretion and without need for providing any prior notice. If the User is under the age of 18, use of the Website is conditional upon receipt of approval from a parent and/or guardian of that User (as defined in the Legal Capacity and Guardianship Law, 5722-1962) for the Terms of Use. Entering credit details of a parent and/or guardian shall be considered their consent to the execution of the purchase on the Website by the minor User.

The services offered on the Website include, inter alia: online contact forms for Users wishing to submit requests and/or inquiries and/or questions to the Site Operator. 9. The User’s right to use the Website, including services offered therein and/or Content (as this term is defined below) is granted to the User only.

The User is strictly prohibited from making commercial use of the Website and/or services and/or Content included therein, including for profit purposes, and may not copy and/or distribute and/or reproduce any part of the Website and/or Content and/or services included therein and/or use, modify, integrate the Website and/or Content into another website or create derivative works, without receiving the Site Operator’s prior written consent.

The Site Operator and/or anyone on its behalf shall not be liable and shall not bear any direct, indirect, consequential damage and/or loss and/or financial loss, hereinafter: “Damage” caused to the User and/or any third party as a result of use of the Website. Without derogating from the generality of the aforesaid, the Site Operator shall not be liable for any damage caused to the User and/or any third party as a result of a purchase on the Website and/or inability to perform a purchase on the Website, caused as a result of an act and/or omission and/or negligence of the Client and/or User and/or any third party. The Site Operator is not responsible for use made by a Client and/or User and/or any other third party of a product not in accordance with manufacturer and/or Website instructions. Use of information and personal details provided by the User on the Website shall be done in accordance with the Website’s Privacy Policy (the “Privacy Policy“).

Use of the Website constitutes confirmation on behalf of the User thereof for use of information and details as stated in the conditions detailed in the Privacy Policy (detailed in the link above), and a declaration on behalf of the User that all information and details provided by them are true and accurate and provided of their free will. There is no legal obligation to provide the information requested on the Website.
13. Website records, including electronic records, regarding actions performed on the Website and including details entered by the User, shall constitute conclusive evidence of the correctness of the actions.
Limitation of Operator Liability

The services offered on the Website and/or engagements by virtue thereof and/or Content included therein, are offered to the User “AS IS,” and the Operator shall not bear any liability regarding said services (subject to any law). The User agrees and confirms that use of the Website and/or services included therein and/or Content (as this term is defined above) is done at their sole responsibility.

In no case shall the Operator and/or anyone on its behalf be liable for any direct, indirect, special, punitive, or consequential damage of any kind and type, as a result of use of the Website and/or links appearing therein and/or Content included therein, including in connection with inaccuracies or lack of updates or errors or omissions occurring in relation to Content and/or any use made thereof by the User at their discretion and sole responsibility.
Personal Details; Personal Information Provided on the Website
16. In order to use services on the Website, you may be asked to fill in a number of personal details including (but not limited to): First Name and Last Name, Phone Number, Email Address (the “Details”).
17. It is emphasized that within the framework of filling in details on the Website, you are not obligated to provide the Details, and the aforesaid depends on your free will only. However, for the purpose of using services offered on the Website, you are required to fill in the Details. Without filling in the Details, it will not be possible to receive the services and/or part of the services offered on the Website.
18. The Site Operator may use the Personal Information or Details provided to it within the framework of use and services on the Website, in accordance with the Site Operator’s Privacy Policy. The User shall have no claim and/or suit and/or demand against the Site Operator regarding retention of said information.
19. The mix of services displayed on the Website is subject to the discretion of the Site Operator, who may update the services, replace them, cease offering them, etc., all at its sole discretion.
Intellectual Property
20. All Intellectual Property rights in the Website, including Content, copyrights, images, trademarks, and the organization and arrangement of information therein are the property of the Operator only.
21. Intellectual Property rights apply, inter alia, to the graphic design of the Website, its databases, its computer code, content and files included therein, and any other detail related to its operation.

23. It is strictly prohibited to collect data from the Website using software such as crawlers, robots, etc., or to distribute such data to the public commercially or within a commercial framework.
24. Additionally, one may not display the Website in a design or graphic interface different from those designed by the Operator, except subject to receiving the Operator’s prior written consent.
25. One may not use any name, mark, or logo identical or misleadingly similar to the trademarks, logos, or name of the Operator without receiving the Operator’s explicit prior written consent.
Information Security and Confidentiality
26. We do and will do our best to maintain the privacy and information security of Website Users. However, we cannot guarantee absolute immunity against penetration of servers where information is stored or penetration of our computers and use of information, services, exposure thereof, or misuse thereof by hostile elements. If such an action occurs, and as long as reasonable security measures were taken, you and/or anyone on your behalf shall have no claim, suit, or demand toward the Operator and/or anyone on its behalf. We recommend that you take appropriate protection measures against virus penetration of the device through which use of the Website is made.

By using the Website, you express your consent that the Operator shall not be responsible for loss of information and/or any damages stemming from or related to such a decision.
29. Additionally, the Operator may at any time block and/or restrict temporarily or permanently a client’s access to the Website at its sole discretion, in addition to any other remedy available to the Operator under any law.
30. The provisions of these Terms of Use, which by their nature survive the termination of engagement, shall remain in force and continue to apply even after termination of engagement.
Jurisdiction and Choice of Law
31. Use of the Website and services/engagements offered through it is subject to the laws of the State of Israel only. Exclusive jurisdiction in any dispute and/or conflict in connection with the Website and/or Terms of Use shall be vested in the competent courts in the city of Tel Aviv-Yafo only.
